A Turkey entry ban can be lifted, depending on why it was imposed, through an administrative application or an annulment action before the administrative court. While the ban continues, entry may in some cases be possible with a special annotated visa (özel meşruhatlı vize). First establish the reason for the ban, its length, the restriction record, the notification date and whether any fine is still unpaid.
How to Lift a Turkey Entry Ban: 2026 Guide
For a foreigner who has an entry ban to Turkey, the right legal route depends on why the ban was imposed. A time-limited entry ban arising from a visa or residence violation and a tahdit kaydı (restriction record) entered on public order or public security grounds are not assessed in the same way.
First, it must be established whether the foreigner really has a Turkey entry ban, which act or restriction record the ban is based on, when it started, for how long it applies and whether the decision was duly notified to the foreigner.
Article 9 of the 6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu (Law No. 6458 on Foreigners and International Protection, YUKK) is the main legal basis for an entry ban to Turkey. Under the Law, an entry ban may as a rule be imposed for a maximum of five years; where there is a serious threat to public order or public security, this period may be extended by a maximum of ten more years. The competent authority may also lift the entry ban when the necessary conditions are met, or allow the foreigner to enter Turkey for a specified period while the ban remains in force.
What Is an Entry Ban to Turkey?
An entry ban to Turkey is an administrative act that prevents a foreigner from entering Turkey for a certain period.
An entry ban may be imposed for different reasons. The most common reasons in practice are:
- exceeding the period of a visa or visa exemption,
- continuing to stay in Turkey after the residence permit has ended,
- violations relating to a work permit or a work permit exemption,
- an entry ban imposed in connection with a deportation decision,
- public order or public security grounds,
- assessments relating to public health,
- certain restriction records entered into the system about the foreigner.
The key point here is that an entry ban and a deportation decision are not the same act.
A deportation decision concerns removing the foreigner from Turkey. An entry ban to Turkey, on the other hand, prevents the foreigner from entering the country again later.
A foreigner may be subject to both acts at the same time, and in some cases there may be only an entry ban or another obstacle to entry.
Ways to Lift an Entry Ban in Turkey
Depending on the reason for the entry ban and the state of the file, the main legal routes are as follows:
| Route | Outcome |
|---|---|
| Administrative application | The competent authority is asked to lift or reassess the entry ban. |
| Annulment action | The İdare Mahkemesi (administrative court) is asked to annul an unlawful entry ban. |
| Özel meşruhatlı vize (special annotated visa) | While the entry ban continues, it may allow entry to Turkey with special permission under suitable conditions. |
The legal outcome of these three methods is not the same. In particular, a special annotated visa does not remove the entry ban. It may allow entry to the country for a specific purpose while the foreigner's entry ban remains in place.
This distinction matters when choosing the method to use.
Step One: Find Out Why the Ban Was Imposed
An entry ban file should not be started by looking only at the length of the ban.
First, the following questions need to be answered:
- What is the act that gave rise to the entry ban?
- Which restriction records exist about the foreigner?
- On what date did the ban start?
- For how long was it imposed?
- Was the decision notified to the foreigner?
- Does the notified document state the reason for the entry ban?
- Is there also a deportation decision about the foreigner?
- Has the fine arising from the visa or residence violation been paid?
- Does the foreigner have a spouse, child, job, education or ongoing medical treatment in Turkey?
This is because the information “I have a 5-year entry ban” alone is not enough to determine the right legal route.
For example, a time-limited ban linked to a visa violation and a restriction record based on a public security assessment such as G-87 are not challenged in court on the same legal grounds.
Can You Apply to the Authorities to Lift the Ban?
Yes. Under YUKK Art. 9/6, the competent authority may lift the entry ban or, while keeping the entry ban in place, allow the foreigner to enter Turkey for a specified period.
For this reason, depending on the features of the file, it is possible to make an administrative application to lift the entry ban. The application should explain, with concrete evidence, why the ban is no longer necessary.
For example:
- having a Turkish citizen spouse or child in Turkey,
- family unity having been impossible in practice for a long time,
- the foreigner having ongoing commercial or professional relationships in Turkey,
- education,
- health and ongoing medical treatment,
- the event that caused the ban no longer existing,
- a criminal investigation ending in a decision not to prosecute or an acquittal,
- changes in the foreigner's legal and personal situation in the following years
may carry weight in the assessment, depending on the nature of the file.
Whether the administrative application will be accepted varies according to the specific features of each file.
Entry Ban Annulment Lawsuit in Turkey
Since an entry ban to Turkey is an administrative act, it may be challenged in an annulment action before the administrative court if it is considered unlawful. The court examines whether the administrative act complies with the law.
In this context, in particular:
- the statutory basis of the entry ban,
- the specific event that gave rise to the ban,
- the information and documents the authority relied on,
- the reasoning of the act,
- the length of the ban,
- proportionality,
- the foreigner's family and private life,
- whether the reasons said to require the ban are still current
may be assessed.
Especially in acts based on public order or public security grounds, the authority using only general and abstract wording is not the same as the authority showing concretely why the foreigner poses a risk.
Decisions of the Danıştay (Council of State) also show that entry ban acts are subject to judicial review in terms of family life, the basis of the act and proportionality. For example, the 10th Chamber of the Danıştay upheld the first-instance judgment annulling an entry ban imposed for a visa violation on a foreigner who was married to a Turkish citizen and had a young child (E. 2016/2616, K. 2021/2318, T. 17.05.2021).
Deadline to Challenge a Turkey Entry Ban in Court
In determining the time limit for a lawsuit against an entry ban to Turkey, the notification date and the nature of the act are important.
Under the 2577 sayılı İdari Yargılama Usulü Kanunu (Law No. 2577 on Administrative Judicial Procedure, İYUK), the general time limit for filing a lawsuit against administrative acts for which no special period is provided is sixty days, and as a rule it starts to run from the day following written notification.
However, in entry ban files it may not be correct to calculate the period by looking only at the “date of the act”.
YUKK Art. 10 provides that the entry ban is notified to the foreigner and that the notification states how the foreigner can exercise their rights against the decision.
For this reason, in the specific file:
- whether the entry ban decision was actually notified,
- on what date it was notified,
- whether the foreigner was informed of their rights in a way they could understand,
- whether an application was later made to the authority
must also be examined separately.
Under İYUK Art. 11, certain administrative applications made within the time limit for filing a lawsuit may also affect the lawsuit deadline. However, the time that passed before the application is not restored; the specific deadline must be calculated according to the notification and application history of the file.
Can the Court Suspend the Entry Ban (Stay of Execution)?
In an annulment action against an entry ban, yürütmenin durdurulması (stay of execution) may be requested if the legal conditions are met.
If a stay of execution is granted, the enforcement of the entry ban under challenge may be temporarily halted until the case is concluded.
However, there is an important distinction at this point:
A stay of execution granted against one entry ban does not automatically remove all other obstacles to entry that exist about the foreigner.
If the foreigner also has:
- another restriction record,
- an ön izin şartı (prior permission requirement),
- a passport that is not valid,
- a visa requirement,
- an unpaid public debt,
- another obstacle to entry under YUKK Art. 7 or Art. 15
these must be assessed separately. For this reason, after the court decision, it is important to check the current status of the file before travelling to Turkey.
Can You Get a Visa While Banned? The Special Annotated Visa
Yes, one of the routes available to foreigners with an entry ban is the special annotated visa.
The current visa statement of the Göç İdaresi Başkanlığı (Presidency of Migration Management) states that a foreigner with an entry ban to Turkey, even if a national of a visa-exempt country, must apply for a special annotated visa by going to the Turkish diplomatic mission in the country where they are.
However, a special annotated visa and the lifting of an entry ban are different things.
Special annotated visa: it does not erase the entry ban; if approved, it allows entry with special permission despite the ban.
Therefore, if the foreigner's aim is to be able to come to Turkey urgently, the annotated visa option may be considered; but if the entry ban is to be removed completely, administrative or judicial action against the ban itself must be dealt with separately.
Since the conditions and application documents for a special annotated visa are a separate topic, for a detailed explanation our “Annotated Visa” guide may be consulted.
Overstay in Turkey: How Long Is the Entry Ban?
In an entry ban arising from a visa, visa exemption, residence or work permit violation, what matters is not only the length of the violation but also how the foreigner left Turkey and whether they paid the fine. According to the official statement of the Presidency of Migration Management, for foreigners who come to the border gate of their own accord before the violation of the right of legal stay is detected by the competent authorities and pay the fine, the periods are as follows:
| Violation of the Right of Legal Stay | Entry Ban |
|---|---|
| Less than 3 months | No entry ban is imposed if the conditions are met |
| 3 months – 6 months | 1 month |
| 6 months – 1 year | 3 months |
| 1 year – 2 years | 1 year |
| 2 years – 3 years | 2 years |
| More than 3 years | 5 years |
This table concerns the situation where the foreigner, before the violation is detected, comes to the border gate of their own accord to leave and pays the relevant fine. It is therefore not the only table applicable to all visa violation cases.
Unpaid Overstay Fine: Is the Ban Automatically 5 Years?
No. The official statement of the Presidency of Migration Management contains a separate scale for foreigners who do not pay the fine, do not comply with the exit period given to them or are deported in certain ways.
The periods announced for this group are as follows:
| Length of Violation | Entry Ban |
|---|---|
| Up to 3 months | 3 months |
| 3 months – 6 months | 6 months |
| 6 months – 1 year | 1 year |
| 1 year – 2 years | 2 years |
| More than 2 years | 5 years |
However, which table applies depends on factors such as whether the foreigner left voluntarily, whether there is a deportation decision about them, whether they complied with the exit period given and whether they paid the fine.
Ban Expired but Still Refused Entry to Turkey
The expiry of an entry ban does not always mean that you can enter directly at the border gate. The Presidency of Migration Management clearly states that, even if the entry ban period has ended, foreigners who have not paid administrative fines and other public debts arising from a visa or residence violation may not be allowed to enter Turkey until these debts are paid.
For this reason, even if the date of an entry ban imposed long ago has passed, before travelling to Turkey:
- whether the entry ban has really ended,
- whether there is an active restriction record,
- whether there is an unpaid fine or public debt,
- whether a visa or special permission is required
should be checked.
Maximum Length of a Turkey Entry Ban
Under YUKK Art. 9, the length of an entry ban to Turkey is as a rule a maximum of five years.
However, if the foreigner is considered to pose a serious threat to public order or public security, the period may be extended by a maximum of ten more years by the competent authority.
Therefore, for entry bans under Article 9 of the Law, the general system is not built on an “indefinite ban” but on specific maximum periods.
Nevertheless, the existence of a prior permission requirement or other restriction records about the foreigner may in practice create a separate obstacle to entering Turkey.
For this reason, in long-running public security files it is not enough to look only at the end date of the entry ban.
Restriction Code vs Entry Ban: Are They the Same?
They are not exactly the same thing. Tahdit kodları (restriction codes) refer to records kept about foreigners in the administrative system. The legal effect of a code may vary depending on the reason it was entered.
Some restriction records lead directly or indirectly to entry to Turkey being blocked, while the legal effect of other records may be different.
For this reason, statements such as:
“I have G-87 in my passport.”
“A Ç- code was entered.”
“I have a deport code.”
are not enough on their own.
First, it must be established which act the code is based on and what legal effect it has for the foreigner.
Since the types of restriction codes and the separate methods for removing each go beyond the scope of this page, the subject is explained separately in our guide titled “What Is a Restriction Code and How Is It Removed?”.
G-87 Restriction Code: Can the Ban Be Lifted?
Restriction files based on public security grounds, such as G-87, must be assessed differently from entry bans arising only from a visa violation.
In these files, the real issue is often not how many days the foreigner overstayed the visa, but why the authority considers the foreigner objectionable in terms of public security.
In the court's review:
- the nature of the information and documents used in the act,
- whether there is a concrete assessment about the foreigner,
- the foreigner's background,
- the outcomes of any criminal investigation or trial,
- family ties in Turkey,
- whether the act is current and proportionate
may become important.
Danıştay decisions show that entry bans with the G-87 restriction code have been the subject of separate annulment actions.
Since the legal nature and removal of G-87 is a separate technical area, for a detailed assessment see our “G-87 Restriction Code” guide.
Entry Ban vs Deportation Order: What Is the Difference?
In everyday speech, both acts are often called “deport”. Legally, however, they are not the same.
Deportation decision:
The act concerning the removal of the foreigner from Turkey.
Entry ban to Turkey:
The act that prevents the foreigner from entering the country again after leaving Turkey.
For this reason, the lawsuit a foreigner files against a deportation decision and the action they take to lift an entry ban to Turkey may be different from each other.
For foreigners held in a GGM (geri gönderme merkezi, removal centre) or facing active deportation proceedings, the deportation process is covered separately in our guide titled “Deportation in Turkey: How to Stop It and Lift the Ban”.
Does a Turkish Spouse or Child Lift the Entry Ban?
Having a Turkish citizen spouse or child does not automatically lift an entry ban. However, family ties can be extremely important in assessing entry bans, particularly long ones with serious consequences.
Under the provisions of the Anayasa (Constitution of the Republic of Turkey) on the protection of family life and the guarantees of the Avrupa İnsan Hakları Sözleşmesi (European Convention on Human Rights) on private and family life, a fair balance must be struck between the administrative act and its effect on the foreigner's family life.
The decision of the 10th Chamber of the Danıştay numbered E. 2016/2616, K. 2021/2318 and dated 17.05.2021 is an example of this approach: the annulment of an entry ban imposed for a visa violation on a foreigner with a Turkish citizen spouse and a young child was upheld.
Nevertheless, submitting a marriage certificate alone is not enough to lift the ban in every file. The reason for the ban, the nature of the family life and the public interest put forward by the authority are assessed together.
Documents Needed to Lift an Entry Ban
The documents required vary depending on the reason for the ban. The main documents that may be examined in practice are:
- passport and previous passports,
- Turkey entry-exit records,
- notification documents for the entry ban or deportation decision,
- INAD documents or documents issued at the border gate,
- existing paperwork relating to the restriction record,
- visas and residence permits,
- fine payment receipts,
- marriage certificate,
- civil registry records for the children,
- identity and residence documents of family members in Turkey,
- employment, company or investment documents,
- student acceptance or education documents,
- health and treatment documents,
- decisions showing the outcome of a criminal investigation or trial,
- documents on a decision not to prosecute, an acquittal or finality of judgment.
It should not be assumed that every document submitted in the file carries the same weight for lifting the entry ban.
The essential point is to submit evidence that answers the reasoning of the ban.
Can a Turkey Entry Ban Be Lifted Early?
Yes. The fact that an entry ban was imposed for five years or another period does not mean the foreigner has to wait for the whole period.
YUKK Art. 9/6 expressly allows the competent authority to lift an entry ban before it expires.
In addition, judicial review of an entry ban alleged to be unlawful is also possible.
For this reason, the idea “I got a 5-year penalty, nothing can be done for five years” is not correct.
However, whether the ban can be lifted depends on the reason for the ban and the specific circumstances of the file.
How to Check If You Have an Entry Ban in Turkey
An application made without knowing whether the ban exists and why is wasted. There are four ways to find out, and they do not give information in the same detail.
- Border gate. A foreigner who is stopped at entry is informed of the basis of the act. This is the most certain but the latest way to find out; the cost is the journey itself.
- Consulate. The existence of the record comes to light during the visa application. Often you are only told that the application was refused, and the code itself may not be disclosed.
- Online check. Online checks the foreigner can run with their own identity details do not always show the details of the record.
- File review through a representative. A lawyer, with a power of attorney, can apply to the relevant authority and review the case file. This is the most reliable way to learn the type, basis and length of the code.
What is decisive is which code the ban is based on; the route to removal changes according to the code. For the types of code, you can refer to the article on the restriction code.
Why Proportionality Matters in Entry Ban Cases
An entry ban is an administrative act, and the authority's discretion is not unlimited. The criterion most debated in judicial review is proportionality: whether the ban imposed is proportionate to the reason on which it is based.
This criterion comes to the fore particularly in two situations. The first is where the reasoning for the ban has not been set out concretely; an act without reasoning cannot be reviewed, and this is in itself a ground of unlawfulness. The second is the weight of the person's ties to Turkey: having a Turkish citizen spouse or child, long-term legal residence and the protection of family unity are weighed against the authority's reasoning in the proportionality assessment.
For this reason, in an annulment action it is not enough to say only “the ban is unfair”; it must be shown concretely what the reasoning of the act is and whether the person's situation leads to a result that is disproportionate to that reasoning.
Conclusion: Identify the Real Reason for the Ban First
The most important step in lifting an entry ban to Turkey is correctly identifying the act applied to the foreigner.
A time-limited entry ban arising from a visa violation, a restriction record entered for public security reasons, an unpaid fine or an entry ban linked to a deportation decision each require a different legal assessment. For this reason, the reason for the ban, the restriction record, the notification date, the length, the fines, the foreigner's family and private life and the purpose of coming to Turkey again must be examined together.
Depending on the state of the file, an administrative application can be made to lift the entry ban, an annulment action can be filed before the administrative court against an unlawful act, or the special annotated visa option can be considered while the entry ban continues.

Frequently Asked Questions
Common questions on this topic
1 Can I challenge a Turkey entry ban in court?
Avukat Esra Ateş
Yes. An entry ban is a separate administrative act and must be notified to you (YUKK Art. 10). The time limit for filing an annulment action before the administrative court is 60 days from the day following written notification (İYUK Art. 7).
2 How long does a Turkey entry ban last?
Avukat Esra Ateş
The statutory maximum is five years; where there is a serious threat to public order or public security, it may be extended by a maximum of ten more years (YUKK Art. 9/3). The Law does not provide for an indefinite entry ban. In legal stay violations, the length is set according to how long the violation lasted.
3 If I overstayed, pay the fine and leave on my own, will I get an entry ban?
Avukat Esra Ateş
According to the statement of the Göç İdaresi (migration administration) dated 09.06.2020, for a foreigner who applies to leave before the violation is detected and pays the fine: if the violation is up to 3 months (3 months itself not included), no ban is imposed; 3-6 months, 1 month; 6 months-1 year, 3 months; 1-2 years, 1 year; 2-3 years, 2 years; more than 3 years, 5 years. The legal basis is YUKK Art. 9/4.
4 How long is the entry ban if I am caught and deported from Turkey?
Avukat Esra Ateş
For foreigners who are deported, do not pay the fine or do not leave, the second table in the same statement applies: violation up to 3 months, 3 months; 3-6 months, 6 months; 6 months-1 year, 1 year; 1-2 years, 2 years; more than 2 years, 5 years. The time limit for a lawsuit against a deportation decision is 7 days from notification (YUKK Art. 53/3).
5 Does a Turkey entry ban end automatically when the period is over?
Avukat Esra Ateş
The ban is limited in time; however, if there is an unpaid administrative fine or public debt, the foreigner's entry may be made subject to prior permission (YUKK Art. 9/7). According to the statement of the Göç İdaresi, a person with an unpaid fine is not allowed to enter even if the ban period has expired. Check your record and any debts before you travel.
6 Can I get a Turkish visa while I have an entry ban?
Avukat Esra Ateş
As a rule, no: a visa is not issued to a foreigner banned from entering (YUKK Art. 15/1-b). A visa may be issued with the Minister's approval (Art. 15/2). The Göç İdaresi Başkanlığı (Presidency of Migration Management) may also allow the foreigner to enter Turkey for a specified period while keeping the ban in place (Art. 9/6). In practice this route is known as the “meşruhatlı vize” (annotated visa); it does not lift the ban.
7 Can I enter Turkey before my entry ban is lifted?
Avukat Esra Ateş
No. A foreigner banned from entry is treated as an inadmissible passenger and is turned back at the border (YUKK Art. 7/1-c). A deportation decision is taken against a foreigner found to have come to Turkey despite the ban (Art. 54/1-ı).
8 Is the deadline to challenge an entry ban the same as for a deportation order?
Avukat Esra Ateş
No. The time limit for a lawsuit against an entry ban is 60 days (İYUK Art. 7). The time limit against a deportation decision is only 7 days from notification (YUKK Art. 53/3). Confusing the two periods leads to an irreversible loss of rights.
9 How do I get a restriction code removed in Turkey?
Avukat Esra Ateş
There are two routes: an application to the Presidency of Migration Management to lift the ban (YUKK Art. 9/6) and an annulment action before the administrative court within the time limit. Which route is suitable depends on the type of code and the reason for the ban.
10 Does marrying a Turkish citizen lift my entry ban?
Avukat Esra Ateş
Marriage does not lift the ban automatically. However, family ties are a strong ground both in a lawsuit and in an application to lift the ban. The 10th Chamber of the Danıştay (Council of State) upheld the annulment of an entry ban imposed for a visa violation on a foreigner married to a Turkish citizen and with a young child (E. 2016/2616, K. 2021/2318, T. 17.05.2021).
11 Can I get a Turkish work permit while I have an entry ban?
Avukat Esra Ateş
No. For a work permit to be granted, the foreigner must not fall within the scope of YUKK Art. 7 (YUKK Art. 27/2). The work permit application of a foreigner reported by the İçişleri Bakanlığı (Ministry of Interior) as having an entry ban is rejected (Law No. 6735 Art. 9/1-f).
12 How can I check whether I have an entry ban in Turkey?
Avukat Esra Ateş
The record can be found out by applying to the il göç idaresi (provincial migration directorate) or, abroad, to a Turkish consulate; the application is made in person or through a lawyer. Not every record may be visible online, so obtaining confirmation from an official authority before you travel is the safest way.
13 Can I apply to lift a Turkey entry ban myself?
Avukat Esra Ateş
Yes. Both the administrative application and the annulment action can be pursued in person or through a lawyer (Avukatlık Kanunu, Attorneyship Law, Art. 35/3). What is decisive is correctly identifying which code the record was entered under and on what date; an application aimed at the wrong record produces no result, and the lawsuit deadline keeps running in the meantime.
14 I own a home in Turkey. Can I come for title deed matters despite my entry ban?
Avukat Esra Ateş
Property ownership does not give a right of entry. To come while the ban continues, you may request permission to enter for a specified period from the Presidency of Migration Management (YUKK Art. 9/6). To complete the matter without coming, tapu (title deed) transactions can be carried out by a lawyer or a relative under a power of attorney drawn up at the Turkish consulate in your country.
15 I am pregnant or have a young child. Can I enter Turkey on humanitarian grounds?
Avukat Esra Ateş
These circumstances do not lift the ban automatically. However, they can be put forward as humanitarian grounds in an annulment action and in an application to the Presidency of Migration Management for permission to enter (YUKK Art. 9/6), and they should be supported with documents.
16 Can I transit through a Turkish airport with an entry ban?
Avukat Esra Ateş
If you do not need to leave the airport's transit area, you have not formally entered Turkey. However, some airlines may refuse boarding to avoid the risk of an inadmissible passenger; speak to the airline before buying a ticket.
