A foreigner deported from Turkey is banned from entering (YUKK Art. 9/2); the ban lasts at most 5 years and can be extended by up to 10 more years where there is a serious threat. Three ways back: wait for the ban to expire, ask the Presidency of Migration Management to lift it or grant time-limited entry, known as an annotated visa (Art. 9/6), or file an annulment action within 60 days of written notification. Paying the fine does not lift the ban; an unpaid fine can block entry.
Can You Return to Turkey After Deportation? Legal Routes and Legislation (2026)
Under Article 9/2 of the 6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu (Law No. 6458 on Foreigners and International Protection, YUKK), a foreigner who is sınır dışı edilen (deported) from Turkey is banned from entering Turkey. The way back depends on the length of this ban, its grounds and whether any fine remains unpaid. The process known in Turkey as "deport kaldırma" (lifting a deportation) is, legally, in most cases not the removal of the deportation decision itself but the lifting of the entry ban attached to it, or obtaining time-limited entry permission despite that ban. In this article we explain the routes for a deported foreigner to return to Turkey, with the time limits and article numbers.
Three Legal Ways to Return to Turkey After Being Deported
A deported foreigner has three routes. The first is to wait for the ban period to expire. The ban lasts at most five years; where there is a serious threat to public order or public security, it may be increased by at most ten more years (YUKK Art. 9/3). Any administrative fine must have been paid. The second is to apply to the Göç İdaresi Başkanlığı (Presidency of Migration Management, called Genel Müdürlük in the Law). The Presidency may lift the ban, or allow entry for a specific period while the ban remains in force (Art. 9/6). In practice this permission is known as a "meşruhatlı vize" (annotated visa). The third is to file an iptal davası (annulment action) against the entry ban before the idare mahkemesi (administrative court) within 60 days of written notification (İdari Yargılama Usulü Kanunu – Code of Administrative Judicial Procedure, İYUK, Art. 7). Paying the visa violation fine does not, on its own, lift the ban.
Turkey Deportation Ban: How Many Years Before You Can Return?
For foreigners deported for violating the rules on legal stay, or who did not pay their fine, the statement of the Göç İdaresi (migration administration) dated 09.06.2020 contains the following table:
| Length of the violation | Entry ban |
|---|---|
| Up to 3 months | 3 months |
| 3 months - 6 months | 6 months |
| 6 months - 1 year | 1 year |
| 1 year - 2 years | 2 years |
| More than 2 years | 5 years |
For bans based on public order or public security, the period is not tied to this table; however, the statutory upper limit is still the one in Art. 9/3. The Law does not provide for an indefinite entry ban. According to the migration administration's statement, a foreigner who has an unpaid administrative fine or public receivable is not allowed to enter, even if the ban period has expired. In this case, governorships may make entry subject to prior permission (Art. 9/7). For this reason, both the ban and any outstanding debt should be checked before you travel.
Route 1: Annotated Visa (Time-Limited Entry Permission) Despite the Ban
As a rule, no visa is issued to a foreigner who is banned from entering (YUKK Art. 15/1-b). The exceptions are a visa issued with the approval of the Minister (Art. 15/2) and the time-limited entry permission that the Presidency grants while the ban remains in force (Art. 9/6). This route, called a "meşruhatlı vize" in practice, does not lift the ban; it only makes entry possible for a specific purpose and period. The application is made to the Turkish consulate in the country where the foreigner is.
What reasons can support an annotated visa application?
The Law does not list the grounds one by one; the permission is at the discretion of the Presidency. The purpose and length of the intended entry must be clearly documented in the application. For example:
- Family: a Turkish citizen spouse or child, or family members legally residing in Turkey.
- Medical treatment: proof, with medical reports, of treatment that must be received in Turkey.
- Education: enrolment at a higher education institution in Turkey.
- Necessary procedures: matters that require your presence in person, such as a court hearing, a title deed transaction or an inheritance procedure.
For details, see our article on the annotated visa.
Route 2: Annulment Lawsuit Against the Entry Ban (Permanent Solution)
An entry ban is a separate administrative act and is notified to the foreigner (YUKK Art. 10). For deported persons, notification is made by the valilik (governorship). If the ban is unlawful, disproportionate or was imposed without regard to the foreigner's family ties in Turkey, a lawsuit is filed for its annulment. The time limit for filing is 60 days from the day following written notification (İYUK Art. 7).
Which court hears a lawsuit against an entry ban?
As a rule, cases are heard by the administrative court of the place where the administrative authority that carried out the act is located (İYUK Art. 32/1). If the ban was imposed by the İstanbul Valiliği (Istanbul Governorship – İl Göç İdaresi, Provincial Directorate of Migration Management), the Istanbul administrative courts have jurisdiction; if it was imposed by the Göç İdaresi Başkanlığı (Presidency of Migration Management), the Ankara administrative courts do. If the court annuls the act, the ban disappears and the foreigner can apply under the general visa regime. Filing the case does not automatically suspend the act; yürütmenin durdurulması (stay of execution) must be requested separately (İYUK Art. 27).
The Danıştay 10. Dairesi (10th Chamber of the Council of State) upheld the first-instance judgment annulling an entry ban imposed for a visa violation on a foreigner who was married to a Turkish citizen and had a young child (E. 2016/2616, K. 2021/2318, T. 17.05.2021). Family ties are the strongest basis in these cases.
Deportation Order vs. Entry Ban: The Legal Difference
Sınır dışı etme (deportation): the decision on removing the foreigner from Turkey (YUKK Art. 53-54).
Türkiye'ye giriş yasağı (entry ban to Turkey; tahdit kaydı – restriction record): a separate decision that prevents a deported foreigner from returning to Turkey for a certain period (Art. 9). It lasts at most five years and, where there is a serious threat, may be extended by at most ten more years.
As a rule, deported persons are banned from entering (Art. 9/2). There are two exceptions. An entry ban may not be imposed on a foreigner who applies to the governorship to leave before their situation is detected, pays their administrative fines and does not exceed the violation periods set by the Ministry (Art. 9/4). An entry ban may also not be imposed on a foreigner who is invited to leave (terke davet) and leaves within the given period (Art. 9/5). No official list of tahdit kodları (restriction codes) has been published. Which code has been entered should be confirmed officially through the il göç idaresi (provincial migration directorate) or a consulate. On the codes, see restriction codes in Turkey.
Deadline to Challenge a Deportation Decision and Why It Matters
A foreigner who is notified of a deportation decision while in Turkey may apply to the administrative court within 7 days of notification. The court decides within 15 days from the completion of the case file (tekemmül), and its decision is final. During the time limit for filing and while the case is pending, the foreigner is not deported, unless they consent (YUKK Art. 53/3). Details: how to stop a deportation order.
Even if this deadline was missed and the foreigner has been deported, returning is not impossible. The 60-day time limit for a lawsuit against the entry ban and the application to the Presidency run separately.
Common Mistakes After Being Deported From Turkey
The most common mistake is trying to enter on a tourist visa, or visa-free, while the ban is still running. A foreigner banned from entry is treated as a kabul edilemeyen yolcu (inadmissible passenger) and is turned back at the border (YUKK Art. 7/1-c). A new deportation decision is issued for a foreigner found to have come to Turkey despite the ban (Art. 54/1-ı).
The second mistake is applying without knowing the type and length of the record. An application aimed at the wrong record produces no result, and meanwhile the time limit for a lawsuit keeps running. The third mistake is forgetting an unpaid fine: even if the ban period has expired, an unpaid administrative fine can block entry. Incomplete or incorrect statements made to consulates also harm later applications.
Planning Your Return: Why the Right Strategy Is Vital
Every file must be assessed on its own merits. The reason for the deportation, the length of the entry ban and the date it was notified, any unpaid fine and your ties to Turkey must be considered together. Applications made without this information often lead nowhere. The attitude "I will simply come back when the period runs out" can end in being turned back at the border gate because of an unpaid fine or a record that has not been updated in the system. A lawyer working in foreigners law can help you choose the right route by identifying the record and the time limits from the outset.

Frequently Asked Questions
Common questions on this topic
1 Can I return to Turkey after being deported?
Avukat Esra Ateş
Yes. There are three routes: wait for the entry ban to expire (with no unpaid fine outstanding), ask the Göç İdaresi Başkanlığı (Presidency of Migration Management) to lift the ban or grant time-limited entry permission (YUKK Art. 9/6), or file an annulment action against the entry ban within 60 days of written notification (İYUK Art. 7).
2 How do I get a Turkish deportation order cancelled?
Avukat Esra Ateş
A deportation decision notified while you are in Turkey can be challenged before the administrative court within 7 days (YUKK Art. 53/3). Once you have been deported, the real obstacle is the entry ban; for that, you can apply to the Presidency of Migration Management to lift it (Art. 9/6) or file an annulment action within the 60-day time limit.
3 How many years is the entry ban after deportation from Turkey?
Avukat Esra Ateş
Under the Law, an entry ban lasts at most five years; where there is a serious threat, it may be increased by at most ten more years (YUKK Art. 9/3). For those deported for violating the rules on legal stay, the migration administration's table applies: a violation of up to 3 months brings a 3-month ban, 3-6 months a 6-month ban, 6 months to 1 year a 1-year ban, 1-2 years a 2-year ban, and more than 2 years a 5-year ban.
4 If I pay my overstay fine, is the Turkish entry ban lifted?
Avukat Esra Ateş
No. Paying the fine does not lift the ban. However, if an administrative fine remains unpaid, entry can be blocked even after the ban period has expired and made subject to prior permission (YUKK Art. 9/7). For a foreigner who applies to the governorship to leave before their situation is detected and pays the fine, an entry ban may not be imposed at all (Art. 9/4).
5 Does marrying a Turkish citizen cancel a deportation?
Avukat Esra Ateş
Not automatically. However, marriage is one of the strongest grounds both in an application to the Presidency of Migration Management and in an annulment action. The Danıştay 10. Dairesi (10th Chamber of the Council of State) upheld the annulment of an entry ban imposed for a visa violation on a foreigner married to a Turkish citizen and with a young child (E. 2016/2616, K. 2021/2318, T. 17.05.2021).
6 What is an annotated visa (meşruhatlı vize) and who can get one?
Avukat Esra Ateş
It is entry permission granted for a specific period to a foreigner who is banned from entering, while the ban stays in place (YUKK Art. 9/6; Art. 15/2). The Law does not list the grounds; you apply to the consulate with documented purposes such as family, medical treatment, education or matters that require your presence in person. It does not lift the ban.
7 Which court do I file a lawsuit in to cancel a Turkish entry ban?
Avukat Esra Ateş
In the administrative court of the place where the administrative authority that carried out the act is located (İYUK Art. 32/1). For a ban imposed by the İstanbul Valiliği (Istanbul Governorship), the Istanbul administrative courts have jurisdiction; for a ban imposed by the Göç İdaresi Başkanlığı (Presidency of Migration Management), the Ankara administrative courts do.
8 What is the deadline to appeal a deportation order in Turkey?
Avukat Esra Ateş
An application to the administrative court against a deportation decision must be made within 7 days of notification (YUKK Art. 53/3). The time limit for an annulment action against an entry ban is 60 days from written notification (İYUK Art. 7).
9 How can I check whether I have a restriction code in Turkey?
Avukat Esra Ateş
By applying to the il göç idaresi (provincial migration directorate) or, from abroad, to a Turkish consulate, in person or through a lawyer. Not all records may be visible electronically, so get confirmation from an official authority before you travel.
10 My spouse was deported from Turkey. How can I bring them back?
Avukat Esra Ateş
Your spouse can apply to the Turkish consulate in the country where they are for time-limited entry permission (annotated visa) on family grounds; the marriage and civil registry records and your residence in Turkey are documented. An application to the Presidency of Migration Management to lift the ban and an annulment action within the time limit should also be considered.
11 Can I get a Turkish work permit after being deported?
Avukat Esra Ateş
As a rule, not while the entry ban continues. A work permit requires that the foreigner not fall within YUKK Art. 7 (Art. 27/2), and the application of a foreigner reported to be subject to an entry ban is rejected (Law No. 6735, Art. 9/1-f). The ban must be lifted first.
12 I was caught working illegally in Turkey. Can I come back?
Avukat Esra Ateş
A deportation decision is issued for a foreigner found working without a work permit (YUKK Art. 54/1-ğ), and deported persons are banned from entering (Art. 9/2). The length of the ban is set within the statutory upper limit. Returning requires the ban to expire, an application to the Presidency of Migration Management or an annulment action.
13 Can I enter Turkey with a G-87 code?
Avukat Esra Ateş
As a rule, not unless the code is removed. G-87 is also subject to the statutory upper limit (YUKK Art. 9/3); it is not indefinite. To remove it, you can apply to the Presidency of Migration Management (Art. 9/6) or file an annulment action within 60 days. According to the Anayasa Mahkemesi (Constitutional Court), an abstract security claim by the administration is not enough (B. 2017/38596).
14 How can a foreigner held in a Turkish removal centre get released?
Avukat Esra Ateş
An application against the administrative detention decision is made to the sulh ceza hâkimi (criminal judge of peace), who decides within five days (YUKK Art. 57/6). A lawsuit against the deportation decision is also filed within 7 days; during the time limit for filing and while the case is pending, the foreigner is not deported unless they consent (Art. 53/3).
15 What happens to my property in Turkey if I am deported?
Avukat Esra Ateş
Being deported does not end your right of ownership. You can have your assets managed, sold or transferred by giving a power of attorney through a consulate or a notary.
16 How long does a deportation lawsuit take in Turkey?
Avukat Esra Ateş
In a lawsuit against a deportation decision, the court decides within 15 days from the completion of the case file, and the decision is final (YUKK Art. 53/3). For lawsuits against an entry ban, the Law sets no special time limit; the duration depends on the court's workload.
17 What should I do if I learn about an entry ban at the airport?
Avukat Esra Ateş
A foreigner banned from entry is treated as an inadmissible passenger, held at the border gate until the procedure is completed and turned back (YUKK Art. 7). The date on any notification served at that point matters for the lawsuit deadline; keep the document and consider, within the time limit, an application to the Presidency of Migration Management or an annulment action.
18 Will I be deported if my residence permit is refused in Turkey?
Avukat Esra Ateş
A deportation decision is issued for a foreigner whose residence permit extension application is refused and who does not leave Turkey within ten days (YUKK Art. 54/1-j). The refusal can be challenged before the administrative court within 60 days of notification (İYUK Art. 7).
19 My child was born in Turkey. Does that help me after deportation?
Avukat Esra Ateş
Being born in Turkey does not, as a rule, give Turkish citizenship; however, a child who cannot acquire the citizenship of any country by birth through their foreign mother and father is a Turkish citizen from birth (Law No. 5901, Art. 8). The parent-child relationship should be documented as a family ground in the entry permission application and in the annulment action.
20 How can I follow my court cases in Turkey after deportation?
Avukat Esra Ateş
By giving a power of attorney to your lawyer in Turkey through a consulate or a notary. If your presence in person is required, time-limited entry permission (annotated visa) can be requested on the ground of a hearing.
