Deportation Appeal Deadline Calculator (7 Days)

Find your last day to file a court case against a deportation decision in Turkey.

Short answer

A case against a deportation decision is filed at the administrative court within 7 days of service of the decision (Law No. 6458, Art. 53/3). The period starts the day after service; weekends and holidays count. If the last day falls on a holiday, the period runs until the end of the next working day (İYUK Art. 8). During the period and while the case is pending, you cannot be deported without your consent.

How is the period counted?

  1. The period starts the day after the day the decision was served (İYUK Art. 8/1). The day of service is not counted.
  2. Weekends and official holidays count; the seventh day is seven days after service.
  3. If the seventh day falls on a holiday, the period runs until the end of the next working day (İYUK Art. 8/2). Saturday is also treated as a holiday.
  4. 28 October and the eves of religious holidays are half days: the holiday starts at 13:00 (Law No. 2429). The calculator does not treat these days as holidays and warns you if one is the last day.

What the calculator does not cover

  • Improper service. The calculation assumes the decision was served properly. If it was never served, or you were only made to sign another document, the situation is different.
  • Judicial recess and administrative leave. The judicial recess extension and administrative leave days are not taken into account, so the last day shown may be early, never late.
  • Administrative detention. Applying to the criminal judgeship of peace against detention in a removal centre is a separate route and is not tied to a time limit in the law (Law No. 6458, Art. 57/6). How to get out of a removal centre

Frequently asked questions

From which day does the 7-day period start?

From the day after the decision was served on you, your legal representative or your lawyer (İYUK Art. 8/1). The date on the decision or the day you were taken to the removal centre does not count; check the date of service on the notice of service.

Some sources say 15 days. Which is right?

The period is 7 days (Law No. 6458, Art. 53/3). 15 days was the rule before 2019; Law No. 7196 (Official Gazette, 24.12.2019) reduced it to 7 days. Sources that say 15 days rely on the old text.

What if the last day falls on a weekend or a holiday?

Holidays in between count. If the last day falls on a holiday, the period runs until the end of the next working day (İYUK Art. 8/2). Decisions of the Council of State and a regional administrative court have treated Saturday as a holiday too.

Can I be deported before the period ends?

Not without your consent. A foreigner cannot be deported during the period for filing the case or, if a case is filed, until it is decided (Law No. 6458, Art. 53/3).

Which court hears the case?

The administrative court. The person who applies to the court also notifies the authority that issued the deportation decision (Law No. 6458, Art. 53/3). The court’s decision in this case is final.
