Real Estate Law

Real estate law governs ownership, transfer of and rights over immovable property. We handle title cancellation and registration actions, construction-in-return-for-flats contracts, partition suits and lease disputes.

Real estate law covers every transaction and dispute concerning the acquisition, transfer and limitation of ownership in immovable property. Because property is usually a person's most valuable asset, a title and zoning review carried out before the transfer prevents most of the loss that would otherwise arise later.

Title Deed Actions

Cancellation of Title and Re-registration

Actions to correct the land registry where registration was improper, or where there was fraud, lack of capacity, a collusive transfer by a deceased person or abuse of a power of attorney.

Registration Based on Possession, and Cadastre

Actions for registration of unregistered land through acquisitive prescription; objections to cadastral determinations.

Construction and Urban Renewal

Drafting and negotiating construction-in-return-for-flats contracts; claims for delay damages, defective performance and termination where the contractor fails to deliver on time or in accordance with the contract. Dissolution of Joint Ownership

Where co-owners cannot agree, ending co-ownership of immovable property by division in kind or by sale.

Frequently Asked Questions

What should I check before buying a property?

Before the transfer you should check any annotations, attachments and mortgages on the title, the zoning status with the municipality, the occupancy permit and, where relevant, the status of the construction servitude or condominium ownership. A promise-to-sell agreement executed before a notary and annotated on the title provides protection.

The developer delivered my flat late — what can I do?

You can claim the delay damages agreed in the contract; if none were agreed, you can claim your loss on the basis of lost rent. Where the delay is serious, termination of the contract may also come into play.

On what grounds can I evict my tenant?

Eviction can be sought only on limited grounds: the need of the landlord or the relatives listed in the law for a home or business premises, the necessity of rebuilding or reconstruction, two justified notices for non-payment of rent, and default. Each ground has its own time limits and procedural requirements.
